1. About the Application

Pumpeat (the "Application") is a mobile application dedicated to fitness and nutrition tracking: workout planning, performance tracking, meal plan management and intake logging.

The Application is published by PUMPEAT, a French simplified joint-stock company (société par actions simplifiée) with a share capital of 2 000 €, registered office at 30 boulevard de Sébastopol, 75004 Paris, France, registered with the Paris Trade and Companies Register under number 109 451 757 (the "Publisher").

Hosting: Render Services, Inc. and Supabase, Inc., on servers located in the European Union.

2. Acceptance of terms

Using the Application implies full acceptance of these terms and conditions. If you do not accept them, you must stop using the Application.

The Publisher may modify these terms at any time. Changes take effect upon publication. It is your responsibility to review the current version regularly.

3. Registration and user account

Creating an account is required to access the Application's features. You agree to provide accurate information and to keep it up to date.

You are solely responsible for the confidentiality of your credentials. Any action performed from your account is deemed to have been performed by you.

Registration is reserved for individuals aged 15 or above. Minors under 18 must obtain consent from their legal representative.

4. Use of the Application

The Application is granted to you on a personal, non-exclusive and non-transferable basis. You agree to use it in compliance with applicable laws and public order.

You may not: (i) attempt to access other users' data without authorization, (ii) reproduce or redistribute any content from the Application without written consent, (iii) post unlawful, defamatory, hateful or infringing content, (iv) use the Application for commercial purposes without consent, (v) attempt to circumvent security measures.

The Publisher reserves the right to suspend or terminate any account that does not comply with these rules, without notice and without compensation.

5. Premium subscription

Some features of the Application are reserved for Premium subscribers. The Application remains usable without a subscription for all the others.

The subscription is offered on a monthly or yearly basis. The current price, in your currency, is shown in the Application and by the store before you subscribe; as of the date of these terms, it is €7.99 per month or €49.99 per year in France.

The subscription is purchased from, and billed by, Apple's App Store or Google Play, depending on the store the Application was installed from. The Publisher does not collect any payment directly and has no access to your payment details.

It renews automatically for the same period, and is charged by the store, unless cancelled at least twenty-four hours before the end of the current period.

Cancellation, plan changes and refund requests are handled from the subscription settings of your Apple or Google account. Cancelling does not delete your Pumpeat account: you keep access to the free features and to your data.

6. Right of withdrawal

The subscription gives immediate access to all Premium features. By subscribing, you expressly request that the service begin before the withdrawal period expires and you waive that right, in accordance with Article L. 221-28 13° of the French Consumer Code.

Refund requests are in any case governed by the terms of the store that collected the payment — Apple or Google — and must be addressed to it directly.

7. User-generated content

By posting content (shared workouts, comments, profile pictures, personal recipes, etc.), you grant the Publisher a non-exclusive, royalty-free, worldwide license to host, display and distribute such content for the operation of the Application.

You remain solely responsible for the content you post and warrant that you hold all necessary rights to it.

Any content reported as inappropriate may be removed or hidden without notice.

The Publisher has zero tolerance for objectionable content and abusive behaviour. Every post and every comment can be reported from within the Application, and every user can block another. Reports are reviewed within 24 hours; content reported by several people is hidden automatically pending that review. An account repeatedly responsible for objectionable content may be suspended.

8. Health disclaimer

The Application provides informational and educational content related to fitness and nutrition. It is in no way a substitute for medical advice, monitoring by a healthcare professional or by a certified coach.

Before starting a workout program or a meal plan, and in case of doubt about your health, consult a qualified professional. The Publisher cannot be held responsible for the consequences of usage unsuitable for your physical condition.

9. Intellectual property

The Application, its code, design, logos, and editorial content (template programs, catalogue recipes, exercise illustrations) are protected by copyright and remain the exclusive property of the Publisher.

Any unauthorized reproduction, representation or exploitation is strictly prohibited.

10. Service availability

The Publisher uses its best efforts to ensure the availability of the Application. Access may however be interrupted for maintenance, updates or force majeure.

The Publisher cannot be held responsible for indirect damages resulting from a service interruption.

11. Personal data

The processing of your personal data is governed by our Privacy Policy, available from the "Terms of Service" section of the Application.

12. Termination

You may delete your account at any time from the "Account management" section of the settings.

The Publisher may suspend or terminate your account without notice in case of serious or repeated breach of these terms.

14. Governing law and jurisdiction

These terms are governed by French law. Any dispute relating to their interpretation or performance falls under the jurisdiction of French courts, subject to mandatory consumer protection provisions.
